This policy is part of the Swokei Terms of Service. It sets out what you may and may not send with Swokei, which is operated by StudioIndex - F.Z.C (Registration Number: 43943). You are the sender of every email you send through Swokei, and you are responsible for it.
1. Business recipients only
- Swokei is for one-to-one business-to-business email. Do not use it to email consumers or private individuals.
- Write only to businesses, about something relevant to their business or to the recipient's role in it.
2. Lawful lead data
- Import only contact details you have a lawful basis to use.
- Do not import purchased, rented or harvested lists of consumers, or lists collected in breach of a website's terms or of the law.
- Do not upload special categories of personal data, such as health, religion or political views.
3. Honest emails
- Send from your own identity and your own domain. Do not impersonate anyone or hide who you are.
- Do not use false or misleading sender names, "From" or "Reply-To" addresses, headers or routing information.
- Do not use subject lines that mislead about what the email contains.
- Include whatever your recipients' laws require, such as your postal address for recipients in the United States or Canada.
4. Opt-outs
- Give every recipient a clear way to say no, and honour it promptly, whether it comes as a reply, an unsubscribe or a request by any other means.
- Do not remove, hide or work around the opt-out line or the unsubscribe handling that Swokei adds.
- Never contact again, from any campaign, mailbox or account, a person who has opted out, and do not re-import them.
5. Countries where consent comes first
In some countries, cold marketing email needs the recipient's prior consent even when the recipient is a business. At the time of writing these include Germany, Austria, Italy, Spain, Poland, the Czech Republic, Denmark, South Africa, South Korea and Israel. In others, consent is needed for sole traders, or for emails to a named person rather than a general business address. You must not send to recipients in these situations without their consent. The law changes, and this list is not legal advice: you are responsible for checking the rules that apply to each recipient.
Swokei may block or limit sending to countries or recipients where cold email requires prior consent.
6. Volume and deliverability
- Do not send bulk or identical mass mailings. Swokei is built for individual, personalised emails.
- Do not try to get around sending limits, warm-up, verification or bounce handling, or use Swokei to damage the reputation of a mailbox or domain you do not own.
7. Other prohibited uses
- anything unlawful, fraudulent, deceptive, harassing or abusive
- phishing, malware, or links to either
- content that infringes intellectual property or other rights
- attempts to access accounts, systems or data you are not authorised to access, or to disrupt the service
8. Enforcement
We may investigate suspected breaches of this policy and, without prior notice where the risk calls for it, pause campaigns, block sending to certain recipients or countries, suspend mailboxes, or suspend or close the account. To report abuse, write to [email protected].
